Time and nature of the guarantee


The Guarantee Fund can pay advances to guarantee benefits from the time when the liquidation proceedings against the employer are opened.

The benefits paid by the Guarantee Fund in case of insolvency of an insured persons collective are advances, and are provisional in nature (BGE 132 V 127 E. 4). Despite any advance payment, pension plans are required to register their claims in case of an employer bankruptcy and the Guarantee Fund must be informed of any subsequent dividend payments.
